Divorce. Nobody likes to talk about it, let alone negotiate with a former spouse or partner. While it is not always necessary to hire a divorce lawyer, the support, guidance and mentorship provided by your lawyer throughout this stressful and complicated process can ensure that your children are protected and your rights are enforced.
Here are 5 reasons for hiring a divorce lawyer:
REASON # 1
In cases where you suffered from an abusive relationship, a lawyer can speak on your behalf and can take the steps necessary to ensure you are protected. This is particularly important if children are involved and you feel your spouse is being abusive, dishonest, or manipulative. The inclusion of a lawyer can eliminate these tactics of intimidation and steps can be taken to protect your children.
REASON # 2
You and your spouse are too busy to manage and understand the legal processes required to finalize your divorce. If you are unfamiliar with family law, the process can be very confusing and overwhelming. Often times, lawyers are often involved late in the process after an unfavorable settlement has already been reached privately between spouses or partners. A lawyer can inform you of your rights and ensure that you reach a settlement which is in your best interests and in the best interests of your children.
REASON # 3
Your spouse found an aggressive lawyer and you feel vulnerable. In a case of a tough separation, it is important that you find a strong lawyer that can effectively advocate for your rights and your best interests with opposing counsel. Retaining a lawyer you can trust and communicate with is essential to reaching an effective separation and divorce.
REASON # 4
You are emotionally distressed and unable to reach a private agreement with your former spouse. Your lawyer will advise you of your legal rights and obligations on issues of property equalization, spousal support, child support, and custody. An effective lawyer can help promote a successful settlement through private negotiations and/or through mediation, avoiding the stresses and costs of proceeding to Court.
REASON # 5
Once a settlement has been reached, a lawyer can help draft a legally binding agreement which outlines all rights and responsibilities of each spouse. By ensuring both you and your spouse have obtained independent legal advice, the agreement will have validity in the eyes of the law and can be used to enforce your rights going forward.
